This a tri-partite agreement for the termination of an employment contract in the PRC when the employment is being carried on through a dispatchment.
This mutual agreement between the company and the dispatched employee is concluded for clarifying the liability, return of property and confidentiality etc. As for the dispatchment, the company has no direct labour relationship with the dispatched employee but only the labour service relationship. Therefore, to terminate/dismiss a dispatched employee, the company shall inform and present a termination notice to the dispatching party, e.g. FESCO, using the template of the dispatching party.
